The protection of the privacy of our patients and clients is important to Pathogenesys LLC. This Privacy Policy and Agreement ("Privacy Policy") will tell you what information is collected or generated and under what conditions it is disclosed. It will explain how we protect that information and what choices you have about how it is used. We urge you to read this Privacy Policy carefully so that you will understand clearly both our commitment to you and your privacy, and how we may collect and use information.
The following are the provisions of our Privacy Policy that describe the information we collect from or about you; ways we disclose, use and protect that information; choices you have, and how you can update your information or contact us with questions. INFORMATION COLLECTED ABOUT YOU
A. Information Collected by or on Behalf of Pathogenesys
Protected healthcare information (PHI) including personal information such as name, address, date of birth, etc. may be collected by and used at Pathogenesys for purposes related to treatment, payment or healthcare operations. During the conduct of our testing activities, Pathogenesys may also generate additional information about you that is considered PHI.
B. Information Collected by Third Parties
Sponsors, partners or clients of Pathogenesys may also collect or generate PHI about you and share this information with us, but only for purposes related to healthcare operations.
DISCLOSURE OF YOUR INFORMATION
Except as set forth in this Section or as specifically agreed to by you, Pathogenesys will not disclose any PHI it gathers from you or generates regarding you. We may release PHI to third parties: (1) to effect treatment decisions as long as a relationship between you and the healthcare provider exists, has or will be established, (2) for purposes related to payment of bills where an established link exists with the insurance company, hospital, bill collectors, or other healthcare providers, (3) to facilitate the regulatory oversight of our healthcare operations, (4) to facilitate the maintenance of Public Health and Safety, (4) to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order; or (5) as specifically authorized by you or your legal representatives in writing. In the event that we are legally compelled to disclose your PHI to a third party, we will notify you unless doing so would violate the law or court order.
Pathogenesys may provide to third parties non-personal information about you that does not allow you to be identified or contacted and that is combined with the non-personal information of other users . For example, we might inform third parties regarding the number of users of our site and the activities they conduct while on our site. We might also inform a pharmaceutical company of the percentage of tumor case that express a certain antigen. Depending on the circumstances, we may or may not charge third parties for this information. We also may not limit the third parties' use of this information, except that we do require third parties to whom we disclose information to agree that they will not attempt to make this information personally identifiable by combining it with other databases or otherwise.
HOW PATHOGENESYS HANDLES PRIVACY AND SECURITY INTERNALLY
Pathogenesys wants your PHI to remain as secure as possible. That is why we use leading technical safeguards and a code of conduct for those employees who are permitted to access our customers' PHI. All electronic and paper record databases are secured from unauthorized access. E-mailing or transmission of PHI over the web is strictly prohibited. Only a limited number of Pathogenesys employees are authorized to access your PHI. All Pathogenesys employees must abide by our Privacy Policy and those who violate our Privacy Policy are subject to disciplinary action, up to and including termination. Although we will make every reasonable effort to protect your PHI from loss, misuse, or alteration by third parties, you should be aware that there is always some risk involved. There is also some risk that thieves could find a way to thwart our security systems.
